GARY DOLAN IN SUCCESSFUL APPEAL AGAINST REFUSAL OF LEAVE TO REMAIN

Gary Dolan, instructed by Duncan Lewis Solicitors on behalf of the appellant, successful appealed against the refusal of leave to remain under paragraph 276 ADE(1)(ii) of the Immigration Rules (20-years-residence). SSHD had alleged that the evidence produced to corroborate twenty years' residence was "entirely self-serving" and had sought to give no weight to it, on Tanveer Ahmed grounds. The judge found that the appellant had, on the balance of probabilities, been in the UK continuously since at least May 1996. The determination was promulgated on Friday 23rd February, and the client, who had been detained at Harmondsworth, was released on the same day. Appellants and their representatives should note the importance of retaining correspondence and other evidence if they wish to satisfy the long residence criteria under the Immigration Rules.
