Jonathan Swain in Supreme Court success
1 March 2019
Jonathan Swain, led by John Hardy QC, recently appeared before the Supreme Court for the Respondent arguing that the High Court had correctly found that the District Judge could only rely on the period since conviction.
Jonathan represented the Respondent judicial authority in the High Court, who upheld the order of the District Judge to extradite Mr Konecny. Mr Konecny appealed to the Supreme Court on whether, as someone convicted in his absence but entitled to an automatic retrial, he ought to be entitled to able to rely on the passage of time since the commission of the offence, rather than the date of conviction.
The Supreme Court unanimously agreed with that interpretation, dismissed the appeal, and he will now be extradited. See link here for a transcript of the Supreme Court judgment.
