Julian Norman in successful article 8 appeal

8 October 2019

Julian Norman successfully represented a mother and two children in an Article 8 appeal against the decision to remove them from the UK. The context was that the older child had lived in the UK for over seven years, and the question was whether it would be "reasonable" for him to leave with his family. The appeal was complicated by a sudden deterioration in the father's mental health. The Upper Tribunal held that it would not be reasonable for the child to be removed simply because he would leave with his mother and sister, and the appeal was allowed.
