Julian Norman successfully represents Appellant in complex Article 8 appeal

11 July 2019

Julian, instructed by Sterling Law Associates, successfully represented the Appellant in a complex Article 8 appeal outside the Immigration Rules. The appeal considered whether a grandparent had a "parental relationship" with an autistic child with complex needs. In allowing the appeal, the Judge commented that "I do not accept the core position of the Home Office as put by [Counsel for the Secretary of State]. He did not show me that he understood what autism means or how it interacts with the effects of sustained abuse. On the other hand, the evidence has persuaded me that Ms Norman is absolutely correct in her assessment. Having found no fault in her legal reasoning, I am minded to adopt her entire skeleton argument as my own findings, in addition to what I have stated above."
