Rebecca Penfold in Successful Immigration Appeal

Rebecca Penfold recently represented a non-EEA national before the First Tier Immigration Tribunal on appeal against the revocation of his residence card. The Secretary of State alleged that the appellant was no longer allowed a residence card as his sponsor, his EEA-national wife, was no longer working and thus not exercising her Treaty rights. The case was further complicated by the allegation (not pursued at appeal hearing) that this was a sham marriage, as the couple had separated and were estranged.
