Rebecca Penfold successfully defends professional driver charged with using his phone whilst driving

Rebecca successfully defended at trial when the Defendant was alleged to have been using a mobile phone whilst driving. The prosecution case fell upon the evidence of a Police Officer who maintained that he witnessed the defendant using his mobile phone whilst driving. Rebecca successfully advanced submissions at the close of the prosecution case on the interpretation of ‘interactive communication’ as required under section 110 Road Vehicles (Construction and Use) Regulations 1986.
The defendant was acquitted without having to give evidence and a Defence Costs Order was granted to the Defendant.
