Richard Heller secures huge reduction in fine for breach of planning notice in the Court of Appeal

R v Kohali, Court of Appeal – Acting on behalf of the Appellant, Richard Heller secured a huge reduction in the fine imposed on a developer for breaching the terms of a Planning Enforcement Notice. In reducing the record fine of £190,000 to £24,000, the Court of Appeal accepted that the Crown Court judge had misinterpreted the offence-creating provisions of the Town and Country Planning Act and had failed to give the Appellant sufficient credit for his early guilty plea.
