Stephen Donnelly, led by Kirsty Brimelow QC, secured the acquittal today at Cardiff Crown Court of Jade Pugh. Ms Pugh had been charged with multiple allegations that she, as a nurse, had wilfully neglected patients in her care who lacked capacity (under s.44 Mental Capacity Act, 2005). The prosecution case centred on the reliability of extensive database records at the Princess of Wales Hospital in Bridgend. After five days of legal argument, the trial judge today determined that the electronic evidence relied upon by the prosecution had lost significant amounts of data and was not admissible.
